We recently published two reports of U.S. police arresting people for dancing at the Jefferson Memorial in Washington DC. Our purpose for publishing those reports was to help expose the growth of the U.S. Police State and the degree to which the state inserts itself into the personal affairs of its citizens. If you find arrests for dancing in public hard to believe, how about being arrested for feeding the homeless! Most Axis readers were appalled at the dancing arrests but the opinion of a few was, "Well, they broke the rules so they deserved it." The questions we have for the latter group is, "Do you think it possible that we have too many rules, who makes them and why?" The 3 people arrested for feeding the homeless in a public park in Florida also broke a rule so perhaps some people think they too deserve to be arrested, humiliated, fined and jailed. In the news article below this commentary, the Orlando Sentinel reports details of these arrests.

A larger story

There is a larger story behind the arrests for dancing and feeding the homeless. It's about overcriminalization, police enforcement and belligerance and a corrupt and arbitrary criminal justice system. When I worked for 8 years in "law enforcement and corrections" a trainer once pointed out that there are enough laws on the books to enable a police or corrections officer to stand on a corner and make arrests all day long. "Everybody's dirty" was one of his favorite lines. So we were told that we had to use judgement about if and when to make an arrest. The guidelines for making those judgements were sufficiently vague to give a cop liberty to be very selective in many cases. There are many examples but among the most obvious is the traffic cop who decides which speeders to ignore and which to arrest. On one occasion, while waiting our turn before the judge in night court in Nashville, Tennessee, for the arraignment of a prisoner who had murdered someone hours earlier, I watched a Metropolitan police officer testify against a prostitute he arrested and brought into court in handcuffs, letting it slip in his testimony before the judge that he had sex with the woman before arresting her. The judge fined her and put her in jail.

It's well known that the United States has the highest criminal population and more laws than any other country. A little Axis of Logic fact-checking on the arrests for feeding the homeless in Florida revealed a list of individuals who have been arrested in Orange County Florida during the last 30 days. Their names, photos and alleged crimes are posted in the Orlando Sentinel even though they have not been tried and have not been convicted of anything.

Guilty until proven innocent

People arrested for not having a valid drivers license (e.g. expired license) were among those arrested, handcuffed and photographed and booked by the police. The U.S. government has always claimed that individuals are "innocent until proven guilty" but the claim is vacuous when the media can make public the name, photo and crime for which a person is arrested, thus destroying a person publically and influencing the outcome of the few who make it to a jury trial. Most do not because they are forced by prosecutors to admit guilt in plea bargains whether they are guilty or not. The state doesn't like paying the expense of jury trials and further loading clogged court dockets.

2,556 people arrested in Orange County, Florida in 30 days

Our fact-checking inquiry revealed that police arrested 2,556 people in Orange County, Florida in the last 30 days. That's over 85 people arrested daily by the police in one county. 2022 of these were men and 534 were women. Among those arrested, judging from their appearance in police mug shots, most are people of color. The range of crimes for which they were arrested extend from murder (3 out of 2,556) to "No valid drivers license" (e.g. expired license). Not having a valid drivers license was among the top ten crimes for which people were arrested, handcuffed and booked by the police. Again, judging from the appearance of these people in their police mug shots, they are poor and the court costs, fines and drivers license fees places a huge financial burden on them. Moreover, people with parking or other traffic fines are not permitted to renew their licenses until those fines are paid - an impossibility for some people.

On June 4, 70% were people of color

67 people were arrested on June 4 alone. Judging from their appearance in police mug shots, 47 of those arrested on June 4 appeared to be people of color (African and Latino origins) and 20 appeared to be "white" although some of those also appeared to be Latinos. So at least 70% of those arrested in Orange County on June 4 were people of color. The 2009 U.S. Census breaks down Orange County's population as 71.7% white, 20.9% black and 25.7% Hispanic/Latino. This of course raises questions about racism and due process - why the police happened to single out some for body, car and home searches and ultimately arrest. Of course your garden variety racist concludes, "You know how them people are." As late funnyman Richard Pryor used to say about U.S. courts, "You go down there looking for Justice; that’s what you find: just us.”

Arrests for 480 different crimes in 30 days

The Orlando Sentinel lists 480 crimes for which people were arrested in a single Florida county over the last 30 days. We have copied, edited for format and republished this list of crimes at the bottom of this page*. We also include a ranking of the top ten (10) crimes among the 480 for which people were arrested.

These problems of hyper criminalization, police belligerance and a warped judical system with endemic corruption have a number of roots:

  • poverty and loss of food, health care, shelter and education;
  • racism and police enforcement policies and practices;
  • police belligerance modeled after aggressive national leaders, militarization, wars;
  • the state's intention to keep the population in utter submission, paradoxically as a bulwark against social unrest and rebellion;
  • massive funding to build and maintain a bloated policing apparatus, court system and prison industry - ostensibly to protect the public;
  • over-criminalization by state and federal legislators and local ordinances rendering just about everybody guilty of something;
  • denial of due process for the accused all the way from the street to the criminal courts and prisons;
  • judges who feed and protect first their own jobs and salaries and then the job security of others who work inside the police and judicial systems.

The U.S. News and Entertainment industry has always created and maintained the myth of America as "the land of the free." But today the collapsing system debunks the myth, revealing the underbelly of a land of the molested, the restricted, controlled, subdued, humiliated and imprisoned. Those who would argue otherwise simply haven't been victimized by the system yet or haven't had a loved one put through the meatgrinder of U.S. justice.

Now another crime has been created for police and court action: Feeding the Homeless.

Orlando police say they violated a city ordinance restricting the feedings.

Members of Orlando Food Not Bombs were arrested Wednesday when police said they violated a city ordinance by feeding the homeless in Lake Eola Park.

Jessica Cross, 24, Benjamin Markeson, 49, and Jonathan "Keith" McHenry, 54, were arrested at 6:10 p.m. on a charge of violating the ordinance restricting group feedings in public parks. McHenry is a co-founder of the international Food Not Bombs movement, which began in the early 1980s.

Arrest documents state that Orlando Food Not Bombs received permits and fed more than 25 homeless people at Lake Eola Park on May 18 and 23. Coleman said the group rejected the permits.

On May 25, Orlando Food Not Bombs illegally fed a large group of homeless people, the police report states. The group on its website called for members to show up that day and defy the city ordinance, according to the report - 2 June 2011. (Read more below the video)

Members of Orlando Food Not Bombs were arrested Wednesday when police said they violated a city ordinance by feeding the homeless in Lake Eola Park.

Jessica Cross, 24, Benjamin Markeson, 49, and Jonathan "Keith" McHenry, 54, were arrested at 6:10 p.m. on a charge of violating the ordinance restricting group feedings in public parks. McHenry is a co-founder of the international Food Not Bombs movement, which began in the early 1980s.

The group lost a court battle in April, clearing the way for the city to enforce the ordinance. It requires groups to obtain a permit and limits each group to two permits per year for each park within a 2-mile radius of City Hall.

Arrest papers state that Cross, Markeson and McHenry helped feed 40 people Wednesday night. The ordinance applies to feedings of more than 25 people.

"They intentionally violated the statute," said Lt. Barbara Jones, an Orlando police spokeswoman.

Police waited until everyone was served to make the arrests, said Douglas Coleman, speaking for Orlando Food Not Bombs.

"They basically carted them off to jail for feeding hungry people," said Coleman, who was not present. "For them to regulate a time and place for free speech and to share food, that is unacceptable."

Orlando Food Not Bombs has been feeding the homeless breakfast on Mondays for several years and dinner on Wednesdays for five years.

Police had not enforced the ordinance while the court battle continued. The U.S. District Court of Appeals for the 11th Circuit in Atlanta ruled that city rules regulating how often large groups of people can be fed in a park do not violate the Constitution.

The penalty for violating Orlando's ordinance is 60 days in jail, a $500 fine or both.

Officers said they found a press release on Markeson when they arrested him stating that group members planned to defy the ordinance Wednesday.

Bail was set at $250 for each person arrested. Cross and Markeson were released from jail early

Thursday. McHenry wants to stay in jail and let the legal process take its course, Coleman said.
